Terms & Conditions, Waiver of Liability and Code of Conduct
By enrolling, attending a trial session, registering for a program, making payment, participating in Academy activities, replying "I ACCEPT" through an approved communication channel, or submitting an online registration form, you acknowledge and agree to be bound by these Terms & Conditions, Waiver of Liability and Code of Conduct.
1. INTRODUCTION
These Terms & Conditions, Waiver of Liability and Code of Conduct (“Agreement”) govern participation in all programs, services, activities, events, camps, assessments, competitions, transportation services and related activities offered by Flying Roses Sport Coaching Services (“the Academy”).
By enrolling, registering, making payment, attending a trial session, participating in any Academy activity, or otherwise accepting Academy services, the participant and/or their parent or legal guardian agree to be bound by this Agreement.
Where the participant is under eighteen (18) years of age, the parent or legal guardian confirms that they have full legal authority to accept this Agreement on behalf of the participant.
2. ENROLLMENT, ELIGIBILITY, CLASS AVAILABILITY & WAITING LISTS
Enrollment & Eligibility
The Academy reserves the right to accept, refuse, suspend, terminate, renew, or decline enrollment at its sole discretion, subject to applicable law.
The Academy may require proof of age, identity, medical fitness, residency, guardianship, previous sporting experience, or any other documentation reasonably required for enrollment, participation, safety, technical assessment, or regulatory purposes.
Enrollment is not guaranteed until all required forms, declarations, approvals, and applicable fees have been completed and received by the Academy.
Class Capacity & Availability
All programs, classes, levels, branches, schedules, and training groups are subject to capacity, availability, technical suitability, operational requirements, and Academy approval.
The Academy may establish or modify maximum class capacities and participant numbers based on safety, coaching requirements, facility limitations, program standards, technical considerations, or operational requirements.
Availability communicated at any particular time is not guaranteed until the participant's place has been formally secured in accordance with the Academy's enrollment and payment requirements.
Class Assignment & Technical Placement
The Academy reserves the right to determine the appropriate class, level, training group, branch, schedule, and development pathway for each participant based on age, technical ability, experience, attendance, behavior, performance, safety considerations, coaching assessment, program requirements, and available capacity.
A technical assessment, recommendation, promotion, or decision assigning a participant to a particular level or training group does not constitute a reservation or guarantee of a place within any specific class, schedule, branch, coach allocation, or training group.
Technical placement and class availability are separate considerations. A participant may therefore be technically eligible for a particular level while being placed on a waiting list or offered an alternative schedule, branch, or training group where capacity is unavailable.
Slot Reservation & Payment
A participant's place shall only be considered secured once the Academy's applicable registration, enrollment, renewal, and payment requirements have been completed within the specified timeframe.
Verbal discussions, coach recommendations, expressions of interest, previous attendance, assessment results, provisional reservations, or participation in a previous package shall not by themselves guarantee or reserve a future place.
Unless expressly confirmed otherwise by the Academy in writing, a secured place applies only for the duration of the package, term, program, or service purchased.
Package Priority & Slot Protection
Where class capacity is limited, the Academy may give priority in future class allocation and slot protection to participants purchasing or renewing longer-term packages, including full-term packages, over participants purchasing shorter-term or monthly packages.
Participants enrolled under monthly or other short-term packages retain their confirmed place for the duration of their active paid package, subject to compliance with this Agreement. Such enrollment does not automatically guarantee continuation of the same class, schedule, branch, or training group for any subsequent package period.
The Academy may establish different reservation periods, renewal priorities, benefits, or slot-protection conditions according to package type, program, level, branch, or capacity requirements.
Fees applicable to monthly or other short-term packages shall be based on the Academy's prevailing rates at the time of each renewal. Purchase of a monthly or short-term package does not guarantee continuation of the same price, promotion, discount, schedule, class allocation, or availability for any subsequent period.
Where a participant purchases a full-term package, the applicable package fee and confirmed class allocation shall remain applicable for the duration of that term, subject to the provisions of this Agreement.
Renewal & Release of Slots
Existing enrollment or previous participation does not automatically guarantee renewal or continued availability of the same class, schedule, branch, coach, or training group.
Where the Academy provides a renewal period or payment deadline, the participant's place shall only remain protected until the applicable deadline and subject to the conditions communicated by the Academy.
If the required renewal, registration, or payment is not completed within the specified timeframe, the Academy reserves the right to release the place without further obligation and offer it to another participant or person on the waiting list.
Release of a place due to failure to complete renewal or payment requirements shall not affect any technical level or promotion recommendation previously made by the Academy, but future placement shall remain subject to availability.
Waiting Lists
Where a class, program, level, branch, schedule, camp, event, or training group has reached capacity, the Academy may place interested participants on a waiting list.
Placement on a waiting list does not constitute enrollment, reservation, confirmation, or guarantee of future availability.
The Academy reserves the right to determine how available places are allocated, taking into consideration factors including package type and duration, renewal status, technical suitability, participant level, age, attendance, program requirements, scheduling requirements, operational considerations, and the best interests of the Academy and its participants.
Waiting-list positions are not necessarily allocated solely according to the date or order in which requests were received.
Waiting List Slot Offers & Confirmation
Where a place becomes available, the Academy may offer the available place to an eligible participant on the waiting list based on the Academy's applicable allocation criteria, technical requirements, package priority, and operational considerations.
An offer of an available place shall remain provisional until the participant completes all applicable registration, enrollment, and payment requirements within the timeframe specified by the Academy.
Unless otherwise stated by the Academy, verbal confirmation, expressions of interest, WhatsApp responses, requests to reserve the place, or other communications shall not by themselves secure the offered place.
The place shall only be considered secured upon receipt of the required payment and completion of any applicable enrollment requirements within the specified deadline.
If the participant or parent fails to complete the required payment or enrollment requirements within the specified timeframe, the offer shall automatically expire without further notice, and the Academy may offer the place to another participant.
The Academy reserves the right to determine whether a participant whose offer has expired remains on the waiting list, is moved to a different waiting-list position, or is required to submit a new request for future availability.
Payment for an offered place secures that place only for the applicable package, term, class, schedule, branch, or program confirmed by the Academy and does not guarantee future renewal or continued availability beyond the confirmed enrollment period.
Alternative Placement
Where a requested class, schedule, branch, level, or training group is unavailable, the Academy may offer an alternative class, schedule, branch, training group, or other suitable arrangement.
The participant or parent may accept or decline the alternative offered. Declining an alternative arrangement does not create an entitlement to a place in the originally requested class or override an existing waiting list or capacity restriction.
3. TRIAL CLASSES
Trial Session Eligibility
Trial sessions are offered at the sole discretion of the Academy and are subject to availability, capacity, scheduling, participant suitability, and Academy approval.
The Academy reserves the right to approve, reject, limit, reschedule, cancel, or discontinue any trial session without obligation or explanation.
One-Time Trial Policy
Unless otherwise approved in writing by the Academy, each participant shall be entitled to one (1) trial session only.
The Academy reserves the right to refuse repeated trial requests or multiple trial sessions for the same participant.
Trial Booking & Attendance
Trial sessions must be booked in advance through the Academy's approved communication channels.
Failure to attend a confirmed trial session without prior notice may result in forfeiture of the trial opportunity and may require advance payment for any future booking.
The Academy reserves the right to cancel or reschedule trial sessions due to operational, safety, staffing, venue, or scheduling requirements.
Applicability of Academy Policies
All trial participants and their parents or guardians shall be subject to the provisions of these Terms & Conditions, Waiver of Liability and Code of Conduct, including but not limited to health declarations, liability waivers, communication policies, photography and media policies, privacy requirements, safeguarding measures, safety standards, and conduct requirements.
Participation in a trial session constitutes acceptance of this Agreement.
Trial Evaluation & Placement
The Academy reserves the right to assess participants during trial sessions and determine their suitability, class placement, level assignment, training schedule, coach allocation, development pathway, and eligibility for enrollment.
Any recommendations made during or following a trial session are subject to further assessment and may be modified at the Academy's discretion.
No Guarantee of Enrollment
Participation in a trial session does not guarantee enrollment, class placement, coach assignment, discounts, promotions, competition participation, future acceptance, or availability of places within any Academy program.
The Academy reserves the right to refuse enrollment following a trial session where it considers such refusal to be in the best interests of the participant, other participants, staff, or the Academy.
Promotional Offers Following Trial Sessions
Any discounts, promotions, special pricing arrangements, enrollment incentives, or offers communicated during or following a trial session shall be subject to eligibility requirements, availability, deadlines, written confirmation, and Academy approval.
No verbal statement made during a trial session shall constitute a binding offer or commitment by the Academy.
Photography, Recording & Observation During Trial Sessions
Trial participants and accompanying parents or guardians shall comply with all Academy policies relating to photography, recording, observation, privacy, safeguarding, and communications.
The Academy reserves the right to restrict observation, recording, photography, or access to training areas where necessary for operational, safeguarding, privacy, safety, or educational purposes.
4. HEALTH, MEDICAL DECLARATION & EMERGENCY TREATMENT
The participant and/or parent/guardian confirms that all relevant medical conditions, injuries, disabilities, allergies, medications, and health concerns have been fully disclosed to the Academy.
The Academy may require medical clearance before permitting participation.
The Academy reserves the right to restrict or suspend participation where health or safety concerns exist.
The participant acknowledges that sports activities involve physical exertion and inherent risks.
The Academy may administer basic first aid when necessary.
In emergency situations, the Academy may contact emergency services, hospitals, medical professionals, and emergency contacts as deemed necessary.
Any medical expenses, ambulance fees, hospital charges, medication costs, treatment expenses, insurance deductibles, or related costs shall remain the sole responsibility of the participant or parent/guardian.
5. ASSUMPTION OF RISK, LIABILITY WAIVER & INDEMNITY
The participant acknowledges and accepts that participation in sports, fitness, gymnastics, martial arts, camps, competitions, transportation services, travel activities, and related programs involves inherent risks including injury, illness, disability, property damage, or death.
Participation is entirely voluntary.
The Academy does not guarantee freedom from injury.
To the maximum extent permitted by applicable law, the participant and/or parent/guardian releases and discharges the Academy, its owners, directors, employees, coaches, contractors, volunteers, representatives, venues, partners, and affiliates from any claims, demands, liabilities, losses, damages, expenses, or actions arising from participation except where directly caused by the Academy’s gross negligence or willful misconduct.
The participant and/or parent/guardian agrees to indemnify and hold harmless the Academy against any claims arising from their actions, conduct, participation, or breach of this Agreement.
6. CODE OF CONDUCT
The Academy is committed to providing a safe, respectful, professional, and positive environment for all participants, parents, guardians, visitors, coaches, staff members, volunteers, and spectators.
All persons attending, participating in, or engaging with Academy activities shall comply with this Code of Conduct.
Respectful Conduct
Participants, parents, guardians, visitors, spectators, coaches, and staff shall treat one another with respect, courtesy, professionalism, and consideration at all times.
All persons shall contribute to maintaining a safe, positive, inclusive, and supportive environment that promotes participant development, wellbeing, and enjoyment.
Prohibited Conduct
The following conduct is prohibited:
- Bullying, harassment, intimidation, discrimination, abuse, threats, or misconduct.
- Verbal, written, physical, emotional, or online abuse.
- Aggressive, disruptive, inappropriate, or offensive behavior.
- Use of inappropriate language, gestures, or conduct.
- Conduct that endangers the safety, wellbeing, or dignity of any participant, parent, coach, staff member, volunteer, or visitor.
- Conduct that interferes with Academy operations, activities, events, competitions, assessments, camps, or training sessions.
Parent Interference & Coaching Authority
The Academy's coaches and technical staff are solely responsible for determining training methods, coaching decisions, technical instruction, class placement, participant progression, competition participation, assessments, team selection, and athlete development pathways.
Parents, guardians, visitors, and spectators shall not interfere with coaching decisions, technical instruction, training activities, assessments, competitions, disciplinary decisions, participant evaluations, or Academy operations.
Parents shall not instruct, coach, direct, criticize, question, or otherwise interfere with participants or coaches during Academy activities.
Communication Standards
All concerns, complaints, suggestions, feedback, requests, and operational matters shall be communicated respectfully through the Academy's official communication channels.
Participants, parents, guardians, visitors, and spectators shall not engage in abusive, threatening, offensive, harassing, or inappropriate communications with Academy personnel, participants, or other parents.
The Academy reserves the right to determine the appropriate communication channel and escalation process for any concern or complaint.
Access to Training Areas, Observation & Parent Conduct During Sessions
To maintain a safe, professional, and effective training environment, the Academy reserves the right to regulate access to training areas, athlete preparation areas, competition areas, staff areas, and other operational spaces.
Parents, guardians, visitors, and spectators shall only enter training areas or restricted Academy spaces with prior authorization from the Academy and must comply with all Academy instructions relating to access, movement, seating arrangements, observation, photography, recording, safeguarding, and conduct.
The Academy reserves the right to determine whether parent observation is permitted and may limit, supervise, restrict, or prohibit observation where it reasonably believes such observation may interfere with participant development, coaching effectiveness, safeguarding requirements, privacy, safety, discipline, or Academy operations.
Parents, guardians, visitors, and spectators shall not interrupt, distract, question, coach, criticize, or otherwise interfere with participants, coaches, officials, staff members, or Academy activities during training sessions, assessments, competitions, performances, camps, events, or other Academy programs.
Compliance with Academy Policies
Participants, parents, guardians, visitors, and spectators shall comply with all Academy policies, procedures, safety requirements, instructions, participation requirements, event rules, venue regulations, and operational guidelines issued by the Academy from time to time.
Failure to comply with Academy policies may result in disciplinary action.
Disciplinary Action
Where the Academy reasonably believes that a person has breached this Code of Conduct, it may take any action deemed appropriate, including:
- Verbal or written warnings.
- Restriction of observation privileges.
- Removal from training sessions, events, competitions, camps, or Academy facilities.
- Suspension of participation.
- Suspension of services.
- Restriction of access to Academy communication channels.
- Termination of enrollment without refund.
- Refusal of future services or enrollment.
- Legal action where appropriate.
The Academy's decisions regarding disciplinary matters shall be final.
The Academy reserves the right to determine the appropriate disciplinary action based on the nature, severity, frequency, impact, and circumstances of the conduct in question.
The Academy shall not be required to apply disciplinary measures in any particular order and may, at its sole discretion, bypass intermediate measures and impose any disciplinary action it considers appropriate, including immediate suspension, removal, termination of enrollment, refusal of future services, or legal action where warranted.
Nothing in this Agreement shall require the Academy to provide prior warnings before taking disciplinary action.
7. COMMUNICATION POLICY & COACH INTERACTION
All administrative matters including fees, schedules, attendance, competitions, assessments, complaints, concerns, credits, refunds, policies, and enrollment matters must be communicated through official Academy channels.
Coaches are not authorized to approve:
- Discounts
- Refunds
- Credits
- Schedule changes
- Competition selections
- Policy exceptions
- Commercial commitments
Parents and participants shall not engage in private communications with coaches regarding Academy business through personal communication channels unless expressly authorized by the Academy.
Any communication outside official Academy channels shall not be binding upon the Academy.
Parents shall not interrupt, instruct, criticize, coach, question, or interfere with coaches during training sessions.
Meetings with coaches may only be arranged through the Academy.
The Academy reserves the right to require an administrative representative to attend any meeting involving a coach and a parent.
Direct one-to-one communication between coaches and minor participants outside Academy-supervised channels is prohibited unless a parent or guardian is included.
8. TRAINING, ATTENDANCE, PROGRESSION & CLASS PLACEMENT
Participants are expected to attend sessions regularly and punctually.
The Academy reserves the right to determine and modify:
- Training groups
- Class levels
- Training hours
- Competition categories
- Development pathways
- Promotion eligibility
based on technical ability, attendance, behavior, performance, safety considerations, and coaching assessment.
The Academy makes no guarantee regarding:
- Athletic progression
- Skill development
- Competition results
- Rankings
- Scholarships
- Awards
- Promotions
- Belt advancement
- Team selection
9. COMPETITIONS, ASSESSMENTS, CAMPS & EXTERNAL ACTIVITIES
Participation in competitions, assessments, camps, workshops, exhibitions, performances, showcases, master classes, seasonal camps, international camps, overseas trips, federation activities, and special events is voluntary and subject to Academy approval.
Selection shall be determined solely by the Academy and coaching team based on attendance, technical readiness, discipline, safety, performance, and program requirements.
Participation is not guaranteed.
Competition fees, federation fees, licensing fees, registration fees, travel costs, accommodation costs, visa fees, transportation costs, insurance costs, uniforms, costumes, equipment, meals, and related expenses are separate from training fees unless expressly stated otherwise.
The Academy may issue event-specific participation agreements which shall prevail over this Agreement in relation to the relevant event.
10. TRANSPORTATION SERVICES
Transportation services are optional and may be offered separately from training programs.
Parents remain responsible for ensuring accurate pickup and drop-off information.
The Academy shall not be responsible for delays caused by traffic, weather conditions, road closures, accidents, governmental restrictions, force majeure events, or circumstances beyond its control.
The Academy’s responsibility begins and ends only at designated pickup and drop-off points and times.
11. FEES, DISCOUNTS, PROMOTIONS, CREDITS, REFUNDS & FREEZE POLICY
All fees must be paid in accordance with the Academy's applicable payment requirements, deadlines, and payment methods.
Enrollment, registration, membership, administration, assessment, event, camp, federation, and related fees are non-refundable unless expressly approved otherwise in writing by Academy Management.
Payment of any fee does not create an entitlement to any discount, promotion, credit, refund, freeze, transfer, or exception except as expressly provided under this Agreement or confirmed in writing by Academy Management.
Refund Policy
If a participant withdraws at least seven (7) calendar days before the first scheduled session, a refund of fifty percent (50%) of the applicable package fee may be issued.
No refunds shall be issued within seven (7) calendar days of the first scheduled session or after the first scheduled session has commenced.
Any refund exception shall require written approval from Academy Management.
Verbal approvals, representations, or commitments regarding refunds shall not be valid or binding upon the Academy.
Discounts, Promotions & Special Offers
Discounts, promotions, scholarships, loyalty benefits, referral incentives, sibling discounts, partner discounts, early renewal offers, promotional codes, special pricing programs, complimentary benefits, and other commercial incentives are offered at the sole discretion of the Academy.
The Academy reserves the right, at its sole discretion and subject to applicable law, to introduce, modify, extend, shorten, suspend, withdraw, replace, or terminate any discount, promotion, incentive, special price, scholarship, loyalty benefit, referral benefit, promotional code, complimentary benefit, or commercial offer at any time.
Unless expressly confirmed otherwise in writing, all discounts, promotions, and special offers are subject to eligibility requirements, availability, capacity, applicable conditions, specified payment requirements, and the validity period determined by the Academy.
The Academy may establish different discounts, promotions, prices, benefits, or commercial offers for different participants, packages, programs, levels, branches, locations, campaigns, customer categories, communication channels, enrollment periods, or promotional periods.
The availability of any discount, promotion, special price, or benefit to one participant, package, branch, level, program, customer category, campaign, period, or communication channel shall not create an entitlement to the same or equivalent offer for any other participant or future transaction.
Only one discount, promotion, promotional code, or special offer may be applied to a transaction unless otherwise expressly approved in writing by Academy Management.
Discounts, promotions, and special offers shall not apply retroactively to registrations, renewals, payments, or purchases completed before the applicable offer became available.
All discounts and promotional benefits are conditional upon compliance with the applicable offer conditions and completion of the enrolled package or program where such completion is a condition of the offer.
The Academy may establish specific terms, deadlines, quantities, participant limits, redemption limits, payment conditions, package requirements, or other eligibility criteria for individual promotions or offers. Where specific promotional terms are communicated, those terms shall apply in addition to this Agreement.
Any modification, suspension, withdrawal, replacement, or termination of an offer shall not affect a transaction already completed and fully paid under that offer, unless otherwise expressly provided in the applicable offer terms or permitted by applicable law.
Expiry, withdrawal, or non-use of a discount, promotional code, special offer, or promotional benefit shall not entitle the participant or parent to compensation, credit, extension, substitution, or application of the expired benefit to a future transaction.
Any exception, accommodation, discount, or special commercial arrangement granted to a participant in one instance shall not create a precedent or entitlement to the same or similar treatment in any future transaction.
Refund, Credit & Adjustment Calculations
Where a refund, credit, transfer, freeze adjustment, package modification, or other financial exception is approved, the Academy reserves the right to recalculate the services used and amounts payable using the Academy's applicable standard published rates before determining the value of any refund, credit, transfer, or adjustment.
Where the original purchase was made using a discount, promotion, special price, promotional code, complimentary benefit, or other incentive, such promotional benefit may be removed for the purpose of recalculating an approved refund, credit, transfer, or adjustment, subject to applicable law and the terms of the relevant offer.
Any approved refund, credit, transfer, or adjustment shall be calculated by the Academy based on the applicable package, services consumed, standard rates, promotional conditions, administrative charges where applicable, and any other amounts properly due under this Agreement.
Class Freeze Policy
Medical freeze requests require an official medical report indicating the participant's inability to participate and the expected recovery period.
Travel freeze requests require submission of outbound and return flight tickets.
Freeze requests must be submitted before or during the relevant absence period and shall not be applied retroactively.
Freeze requests shall only be considered for absences of fourteen (14) consecutive calendar days or more.
The total combined freeze period shall not exceed sixty (60) calendar days within any twelve-month period unless otherwise approved in writing by Academy Management.
The duration of an approved medical freeze shall be determined based on the period supported by the applicable medical documentation. The duration of an approved travel freeze shall be determined based on the travel period evidenced by the submitted outbound and return travel documents.
An approved freeze temporarily suspends the participant's package or enrollment entitlement for the approved freeze period. A freeze shall not be treated as an entitlement to individual replacement or make-up sessions for each session missed during the approved absence.
Following an approved freeze, the Academy may restore the affected training entitlement by extending the package validity period, adjusting the package end date, providing access to equivalent scheduled training, or applying another reasonable arrangement determined by the Academy based on the participant's program, level, training frequency, Academy calendar, technical requirements, schedule, capacity, and availability.
Participants enrolled in programs involving multiple training sessions per week, including intensive or competitive levels, shall not be entitled to individual replacement sessions on a session-for-session basis. The Academy shall determine the appropriate method of restoring the approved frozen period, taking into consideration the participant's training program, safety, technical requirements, and available training schedule.
An approved freeze does not guarantee continuation of the same coach, class, schedule, branch, training group, or individual training days during any extended or adjusted period.
Any extension, adjustment, replacement training entitlement, or other arrangement resulting from an approved freeze must be utilized within the validity period determined by the Academy. Any unused entitlement remaining after that period shall expire without refund, credit, transfer, replacement, or compensation, unless otherwise approved in writing by Academy Management.
12. SCHEDULE, VENUE, COACH & PROGRAM CHANGES
The Academy reserves the right to modify schedules, training times, venues, coaches, class structures, training groups, program formats, or delivery arrangements due to operational requirements, facility availability, staffing requirements, safety considerations, regulatory requirements, events, competitions, force majeure circumstances, or other reasonable business or technical requirements.
The Academy may provide alternative schedules, venues, coaches, classes, training arrangements, credits, extensions, or other reasonable alternatives where appropriate and at the Academy's discretion.
To the maximum extent permitted by applicable law, reasonable changes made in accordance with this Section shall not, by themselves, constitute grounds for refunds, credits, cancellations, compensation, or termination, provided that where a material change substantially affects the Academy's ability to deliver the purchased service, the Academy may determine an appropriate alternative arrangement or remedy in accordance with this Agreement and applicable law.
13. SUSPENSION, TERMINATION & RIGHT TO REFUSE SERVICE
The Academy may suspend or terminate participation without refund where:
- Fees remain unpaid.
- Policies are breached.
- Conduct is inappropriate.
- Safety concerns arise.
- Continued participation is deemed contrary to the interests of the participant, other participants, staff, or the Academy.
The Academy reserves the right to refuse future services, renewals, transfers, participation, assessments, competitions, camps, events, or enrollments.
14. UNIFORMS, EQUIPMENT, PROPERTY & PARTICIPATION REQUIREMENTS
Participants must comply with all Academy requirements relating to uniforms, personal equipment, apparatus, protective gear, training materials, safety equipment, and any other items designated by the Academy for participation in its programs and activities.
Participants are responsible for obtaining, maintaining, and bringing the required uniform, equipment, apparatus, protective gear, and training materials necessary for participation.
The Academy reserves the right to determine whether a participant's uniform, equipment, appearance, safety gear, or preparation meets the standards required for participation.
Where a participant attends without the required uniform, equipment, apparatus, protective gear, or other mandatory participation requirements, the Academy may, at its sole discretion:
- Restrict participation in part or all of the session.
- Require the participant to observe rather than actively participate.
- Exclude the participant from specific activities, exercises, assessments, performances, competitions, sparring sessions, demonstrations, or events.
- Remove the participant from the session where safety, operational, educational, or disciplinary concerns exist.
No refund, credit, make-up session, replacement session, compensation, or fee adjustment shall be provided where participation is restricted or denied due to failure to comply with Academy uniform, equipment, safety, or participation requirements.
Participants shall be responsible for any loss of, damage to, or misuse of Academy-owned equipment, facilities, apparatus, training aids, uniforms, or property caused intentionally, negligently, or through misconduct.
The Academy shall not be responsible for any loss, theft, damage, or deterioration of personal property brought onto Academy premises or used during Academy activities.
Repeated failure to comply with Academy uniform, equipment, safety, appearance, or participation requirements may result in disciplinary action, temporary suspension, removal from activities, restriction from assessments or competitions, or termination of enrollment at the Academy's discretion.
15. MEDIA, PHOTOGRAPHY, RECORDING, SOCIAL MEDIA & REPUTATION
The Academy may photograph, record, or film participants for operational, educational, promotional, marketing, training, and administrative purposes.
Parents may opt out through written notice submitted before participation.
Parents, participants, visitors, and guests may not record, photograph, livestream, publish, distribute, or share training sessions, coaching methods, meetings, participant information, or Academy operations without prior Academy approval.
The Academy reserves the right to request removal of unauthorized content.
Parents and participants shall not publish false, misleading, defamatory, abusive, confidential, or reputation-damaging statements regarding the Academy, its employees, coaches, participants, or operations.
Nothing in this clause restricts lawful reporting to competent authorities.
Parents and participants shall not create, administer, or represent unofficial groups, committees, associations, or communication channels on behalf of the Academy without the Academy's prior written approval.
16. INTELLECTUAL PROPERTY
All intellectual property rights relating to the Academy's programs, methodologies, training systems, lesson plans, curricula, assessments, choreography, routines, dances, performances, competition programs, music edits, artistic works, instructional materials, videos, photographs, graphics, publications, digital content, documents, templates, worksheets, event concepts, camp programs, coaching materials, athlete development programs, technical materials, branding, logos, trademarks, and any other materials, content, systems, or works created, developed, adapted, commissioned, delivered, or used by the Academy shall remain the exclusive property of the Academy.
Enrollment, participation, attendance, payment of fees, receipt of services, competition preparation, choreography fees, private coaching fees, camp fees, event fees, or any other payments shall not transfer ownership of any intellectual property rights to any participant, parent, guardian, visitor, third party, or organization.
Participants, parents, guardians, visitors, and third parties shall not reproduce, copy, modify, record, distribute, publish, teach, commercialize, license, transfer, sell, exploit, or authorize the use of any Academy intellectual property without the Academy's prior written consent.
The Academy reserves all rights, title, and interest in its intellectual property, whether existing now or developed in the future, including any improvements, adaptations, modifications, enhancements, or derivative works created during the course of Academy activities, programs, services, events, camps, competitions, assessments, or training.
17. PRIVACY & DATA PROTECTION
The Academy shall process personal information in accordance with applicable UAE laws.
Personal information may be collected, stored, processed, and used for operational, administrative, safety, legal, educational, and service delivery purposes.
The Academy may retain records for a period deemed necessary to satisfy operational, legal, accounting, regulatory, insurance, or safeguarding requirements.
18. ELECTRONIC COMMUNICATIONS & ACCEPTANCE
Parents are responsible for maintaining accurate contact details.
Electronic acceptance, online registration, digital signatures, payment of fees, WhatsApp confirmations, email confirmations, or other express electronic acknowledgment shall constitute acceptance of the version of this Agreement applicable to the relevant enrollment, registration, purchase, program, or service. Acceptance of any amended or updated version of this Agreement shall be governed by Section 21.
Official Communications
The Academy may communicate with participants and parents through WhatsApp, SMS, email, mobile applications, websites, social media platforms, communication portals, and other electronic channels.
Only communication groups, communities, channels, or platforms created or authorized by the Academy shall be considered official Academy communication channels.
Group Communications
The Academy may use group communication platforms, including WhatsApp Communities, WhatsApp Groups, broadcast lists, and similar communication tools, for operational, administrative, educational, event-related, safety, and informational communications.
Participants and parents acknowledge that participation in such communication groups may make certain information, including names, profile photos, and contact numbers, visible to other group members in accordance with the settings and functionality of the relevant platform.
The Academy shall not be responsible for the privacy practices, actions, communications, or conduct of third-party platform providers or other group participants.
Communication Conduct
Participants and parents shall use Academy communication platforms responsibly and shall not use such platforms for harassment, advertising, solicitation, unauthorized promotions, dissemination of false information, or any activity that may disrupt Academy operations.
Removal from Communication Groups
The Academy reserves the right to add, remove, restrict, mute, or manage participants within Academy communication channels as deemed necessary for operational, administrative, safeguarding, or disciplinary reasons.
19. FORCE MAJEURE
The Academy shall not be liable for delays, interruptions, cancellations, venue changes, schedule changes, or service disruptions resulting from events beyond its reasonable control including governmental actions, public health emergencies, war, civil unrest, natural disasters, utility failures, transportation disruptions, venue closures, or force majeure events.
Where feasible, the Academy may provide alternative arrangements, make-up sessions, credits, online instruction, or substitute services.
20. GOVERNING LAW & DISPUTE RESOLUTION
This Agreement shall be governed by the laws of the United Arab Emirates.
The parties shall first attempt to resolve disputes amicably through good-faith discussions.
Where permitted by law, mediation or arbitration may be pursued before court proceedings.
Any dispute not otherwise resolved shall be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates.
21. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties and supersedes prior discussions, representations, advertisements, brochures, social media posts, verbal statements, presentations, or communications.
Any amendment, exception, waiver, credit, refund, discount, accommodation, or special arrangement shall only be valid if approved in writing by Academy Management.
The Academy reserves the right to amend, update, replace, or supplement this Agreement from time to time to reflect changes in applicable law or regulations, Academy policies, programs, services, operational requirements, safety requirements, commercial practices, or other reasonable business requirements.
Updated versions of this Agreement may be published or communicated through the Academy's website, mobile application, registration or booking platforms, email, WhatsApp, payment communications, or other official Academy communication channels.
Unless otherwise required by applicable law, amendments shall take effect from the effective date specified by the Academy and shall apply to enrollments, renewals, purchases, services, or participation occurring on or after that effective date.
Where an amendment materially affects an existing active enrollment or package, the Academy shall apply such amendment subject to applicable law and any notice requirements that may apply.
Renewal, purchase of a new package, registration for a new program or service, or other express acceptance after the effective date of an updated Agreement shall constitute acknowledgment and acceptance of the updated Agreement. Where changes are lawfully applicable to an existing active enrollment or package, continued participation following applicable notice may constitute acceptance to the extent permitted by applicable law.
If a bilingual version exists, the English version shall prevail in the event of inconsistency unless otherwise required by applicable law.
